By entering for the New Year Mega Lottery draw, Eligible Participants agree to be bound by these Terms and Conditions.

New Year Mega Lottery Ltd is a registered lottery company in Nigeria with (RC 1762434) and is registered with and licensed by the National Lottery Regulatory Commission (License number …...) to operate the New Year Mega Lottery.

New Year Mega Lottery Ltd is located at House 4, 611 Road 7th Avenue Gwarimpa.

ELIGIBILITY
1. The New Year Mega Lottery is open to residents of Nigeria who are 18 years of age and above.
2. Employees of the New Year Mega Lottery Ltd are ineligible to enter the Raffle.
3. No tickets can be sold to, on behalf of, or for a person under the age of 18 years. If a ticket is sold unknowingly to, on behalf of, or for a person under the age of 18 they will be refunded, exempt from the Raffle and will forfeit their prize if any.
4. 4. Those persons who satisfy the terms and conditions are considered Eligible Participants.
RAFFLE ENTRIES
Eligible Participants may purchase more than one entry for each Monthly Draw and Mega Draw. There is no maximum to the number of entries an individual can make.
TICKET PRICE
New Year Mega Lottery Tickets shall be N200 per ticket.
PAYMENT
Payment for Raffle tickets can be made by debit/credit card or cash. Full payment for each ticket must be received in cleared funds before the ticket can be issued. Only tickets for which full payment has been received are eligible to win a prize. All Raffle entry sales are final and no refunds shall be made at any time. All participants acknowledge that their payment of N200 per entry to the Raffle does not guarantee that they will win any prize.
NEW YEAR MEGA LOTTERY RULES
1. New Year Mega Lottery Tickets shall come in 8 different colours.
2. The Lottery winning Numbers shall be 8 different Numbers.
3. A single ticket purchased qualifies buyers for all the eleven draws I.e., Ten (10) Monthly Draws February to November and the New Year Mega Draw.
4. The more tickets you buy the higher the chances of winning and every ticket has equal potential to win.
5. Tickets shall expire at the end of each year and shall not be valid for the preceding Year.
6. Ticket sales shall commence on the 2nd of January each year and close on the 1231st of December each year.
7. Tickets bought are at the owner’s risk. The company shall not be responsible for any ticket lost during the valid years of the ticket.
8. Winners have 90 days to claim their winning after which they shall not be eligible to make any claims.
9. Before paying for a ticket, buyers should make sure the ticket is correctly scanned into the seller’s portal to qualify for draws.
10. New Year Mega Lottery will sell physical tickets in all 36 States and the FCT, Communities and Villages of the Federation.
11. New Year Mega Lottery is a spinning-based lottery which shall operate automatically in an 8 Spinning Machine with 101 balls each in the Machine and Ball will be sucked and displayed for winners to emerge in each category.
12. The minimum age required is 18 years and above.
13. Any person who falsifies their age will automatically forfeit the right to a prize
14. The duration of the draw is fixed.
15. Each draw will be broadcasted live on National TV and other platforms for streaming.
16. New Year Mega Lottery shall produce 23 Winners per month for 10 months making a total of 230 Winners in the monthly category and 50 winners in the mega draw category including the jackpot winning every 1st of January 2023.
17. The result of each raffle draw is final. No correspondence will be entered into.
18. There are no alternatives to any prize and no interest will be payable. Prize money will be paid by cheque, bank draft, or electronic transfer to the winners within 5 working days of the draw.
19. New Year Mega Lottery reserves the right to cancel any draw due to technical failure, malfunctioning of the raffle spinning Machine and other major unresolved problems with the approval of the National Lottery Regulatory Commission.
20. The date of the next Raffle draw will be advertised on the New Year Mega Lottery website and also by our media partners.
21. The winning tickets and prizes will be published on the New Year Mega Lottery website and publicized by our media partners.
22. Winners of the raffle draw will be notified by phone call and SMS.
23. New Year Mega Lottery encourages every citizen to play responsibly.
24. If tickets are presented by ineligible individuals, the company has the duty not to pay Winning Prizes to such individuals irrespective of whether they may have won in the lottery draw.
25. New Year Mega Lottery reserves the right to refuse participation in the lottery services and sales of tickets to any person.
26. The Winners are solely responsible for claiming any prizes won.
27. Winners shall be required to provide a valid means of identification such as NIN, International Passport, Voter’s Cards and Driver’s Licence to claim their prize.
28. By participating in the New Year Mega Lottery, the winner agrees to take part in all promotional activity requested by New Year Mega Lottery and the organization reserves the right to use the name and location of the winner, and their photograph, in any publicity.
PRIVACY
New Year Mega Lottery is committed to protecting the privacy of all participants. Personal information that is collected from participants is used lawfully under the Nigeria Data Protection Regulation (NDPR) 2019.

We will respond to initial complaints and queries within 2 days of receipt of the complaint. If the complaint is not satisfactorily resolved, the matter will be escalated appropriately in accordance with our Complaints Handling Policy.
If a satisfactory outcome can still not be reached, the matter will be referred to National Lottery Regulatory Commission, which acts as an impartial adjudicator on disputes that arise between lottery operators and their customers.
PROTECTION OF CHILDREN
The following procedures are in place to prevent under-age persons from participating in lotteries:
1. New Year Mega Lottery will ensure that the design, appearance and play styles of the raffle does not have particular appeal to young people;
2. On all data lists used for the promotion of lotteries all persons under the age of 18 will be excluded;
3. The Terms and Conditions of play which can be accessed by the player, clearly state that any person who falsifies their age will automatically forfeit the right to a prize, thus discouraging participation.
EVENTS OUTSIDE OUR CONTROL
We will not be liable or responsible for any failure to perform or delay in performance of, any of our obligations under the Contract or these Terms and Conditions that are caused by events outside our reasonable control ("Force Majeure Event").
A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
1. Strikes, lockouts, lockdowns or other industrial action.
2. Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
3. Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disasters.
4. The postponement or cancellation of any Draw.
5. The acts, decrees, legislation, regulations or restrictions of any government or regulator.
Our performance under the Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavors to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.
PUBLICITY
1. We reserve the right to publicize and promote details of winners including but not limited to the sum of Winnings. Your participation in the New Year Mega Lottery is an indication that you agree to us including your details on the Website if you are a winner at our discretion. The details to be published are your name and the prize won.
2. 2. All media enquiries regarding us received by you must be referred to us immediately.
INDEMNITY
You agree to indemnify and hold harmless New Year Mega Lottery Ltd, our directors, officers, employees, shareholders, agents and affiliates, our ultimate parent and parent companies and any of our subsidiaries against all claims, losses, costs, expenses, liabilities and damages (including legal fees) (whether direct, indirect, special, consequential, exemplary or punitive or other) arising from any participation in the New Year Mega Lottery.
You agree to fully indemnify us against all claims, losses, costs, expenses, liabilities and damages (including legal fees) (whether direct, indirect, special, consequential, exemplary or punitive or other) arising out of any breach by you of any provision of these Terms and Conditions.
WAIVER
1. If we fail, at any time during the term of the Contract, to insist upon strict performance of any of your obligations under the Contract or any of these Terms and Conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under the Contract, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.
2. A waiver by us of any default shall not constitute a waiver of any subsequent default.
3. No waiver by us of any of these Player Terms and Conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing in accordance with clause J above.
SEVERABILITY
If any of these Terms and Conditions or any provisions of the Contract are determined by any court or competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
ENTIRE AGREEMENT
1. These Terms and Conditions, and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of any Contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.
2. We each acknowledge that, in entering this Contract, neither of us has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between us prior to such Contract except as expressly stated in these Terms and Conditions.
3. Neither of us shall have any remedy in respect of any untrue statement made by the other, whether orally or in writing, prior to the date of any Contract (unless such untrue statement was made fraudulently).
OUR RIGHT TO VARY THESE PLAYER TERMS AND CONDITIONS
1. We have the right to revise and amend these Terms and Conditions from time to time.
2. Changes to these Terms and Conditions will be notified to you by a prominent notice on the Website which you will need to accept by ticking the appropriate box, prior to coming into effect. Your participation in the New Year Mega Lottery will be governed by the amended terms as soon as the amendments are notified on the Website. If you are not happy with any amendments to these Terms and Conditions, you may seize from participating in the New Year Mega Lottery. It remains your responsibility to check these Terms and Conditions periodically to ensure that they meet with your approval. If you continue participating in the New Year Mega Lottery, your continuation will be confirmation of your acceptance of the amended Terms and Conditions.
THIRD-PARTY RIGHTS
Unless otherwise expressly stated, nothing within these Terms and Conditions shall create or confer any rights or any other benefits in favour of any person other than you and us.
NO AGENCY
Nothing in these Terms and Conditions is intended or should be construed as creating any agency or any other form of joint enterprise between you and us.
GENERAL
In these Terms and Conditions, reference to the singular shall include references to the plural and vice versa. Headings are for convenience only and shall not affect interpretation.
LAW AND JURISDICTION
1. The provision of the New Year Mega Lottery services is governed by the laws of Nigeria. Any dispute arising from, or related to, the New Year Mega Lottery and these Terms and Conditions shall be subject to the applicable laws of Nigeria and the parties submit to the exclusive jurisdiction of the courts of Nigeria.
2. The New Year Mega Lottery services provided by us are intended exclusively for players who are not prohibited by the laws of any applicable jurisdiction from playing the New Year Mega Lottery.
3. We will not be liable for any illegal or unauthorized use of the New Year Mega Lottery website or its respective services.
RESPONSIBLE RAFFLE, LIMITS AND SELF-EXCLUSION
We maintain a strong commitment to provide all our ticket buyers with a responsible Raffle environment. Raffle should be enjoyed as a recreational activity aimed at giving back to the community by funding projects for good causes; however, it can nevertheless also cause a problem for a minority of ticket buyers. We aim to prevent compulsive usage and underage access to the Services while providing a friendly and entertaining Raffle experience.
